Terms of Use

These Terms of Use ("Terms") govern your use of the Hanasu² mobile application and the Hanasu² website (together, the "Service"), operated by Hanasu² ("us", "we", or "our"). By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

The Service

Hanasu² is a language practice app. You hold conversations with an AI character and receive feedback from an AI tutor. The Service is a practice and learning aid, not a certified language course, and does not guarantee any particular learning outcome.

AI-Generated Content

• Conversations, feedback, corrections, and spoken audio in the Service are generated by artificial intelligence. AI output can be inaccurate, incomplete, or inappropriate despite our efforts to prevent this. Use your own judgment before relying on it.
• AI characters are fictional. Nothing they say represents our views, constitutes professional advice, or should be treated as factual without verification.

Acceptable Use

You agree not to use the Service to engage in, promote, or attempt any of the following (the list is representative and not exhaustive):

• Any unlawful activity, including violation of any laws, statutes, ordinances, or regulations;
• Generating content that is abusive, harassing, hateful, or harmful to others;
• Probing, overloading, disrupting, or circumventing the technical safeguards of the Service or its infrastructure;
• Using automated means to access the Service or extract data from it;
• Reselling or redistributing the Service or access to it.

We may suspend or terminate access to the Service for violations of this policy.

Intellectual Property

The Service, including its source code, design, logos, graphics, and other content we provide, is owned by us or our licensors and protected by applicable intellectual property laws. You may not copy, distribute, modify, decompile, reverse engineer, or create derivative works from the Service without our prior written permission. You retain whatever rights you may have in the things you say to the Service, and you grant us the right to process that content as needed to operate the Service.

Purchases and Subscriptions

Parts of the Service may be offered for a fee, such as subscriptions purchased through the App Store. Prices are shown before purchase. Payment, renewal, and cancellation of App Store purchases are managed through your Apple account and are subject to Apple's terms. Except where required by law, purchases are non-refundable.

Availability and Force Majeure

We aim to keep the Service available at all times but do not guarantee uninterrupted availability. The Service depends on third-party AI providers and infrastructure that may fail, change, or impose limits outside our control. We will not be liable for delays or failures caused by events beyond our reasonable control.

Disclaimer of Warranties

The Service is provided on an "as is", "as available", and "with all faults" basis. To the extent permitted by applicable law, we make no representations or warranties about the reliability, suitability, or accuracy of the Service or any content generated within it, and we disclaim all warranties regarding the Service and its operation.

Limitation of Liability

To the maximum extent permitted by applicable law, we will not be liable for any indirect, incidental, punitive, special, or consequential damages arising out of or in connection with your use of the Service or any content made available through it. You agree not to hold us liable for losses arising out of events beyond our reasonable control.

Indemnification

You agree to indemnify, defend, and hold us harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms, your use of the Service, or your violation of any law or the rights of a third party.

Severability

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed. The validity of the remaining provisions shall not be affected.

Changes to These Terms

We reserve the right to modify these Terms at any time, effective upon posting an updated version on this page. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms. We also reserve the right to modify or discontinue features of the Service at our discretion.
